Changing lanes with a risky switch

PROMHOUSE project


Shortly before the 70th birthday of the Condominium Act due in 2021, the biggest reform of this law in its history took place. Wohnen im Eigentum (en. Living in ownership) in cooperation with IWO as part of the PROMHOUSE project has summarised its view of the reform for you once again in retrospect.

Serious changes have affected the owners of around 10 million flats across Germany since 01.12.2020. With the comprehensive reform of the Condominium Act, the condominium owners' association (WEG) receives the entire responsibility for the management of the common property. The position of the individual condominium owners vis-à-vis the WEG, the position of the administrator and the position of the advisory board have been redefined. The clear allocation of roles creates legal clarity. However, it is unclear whether and how the owners, as consumers unfamiliar with the law, can keep the reins of action in their hands in practice. The new facilitations for enforcing building measures also raise questions. Structural proliferation and cost chaos could be the price to be paid for ensuring that condominiums no longer "fossilise".
